Booking
Terms and Conditions
PARTIES
The owners
of the property are Mrs. J & Mr. C D Curtis - referred to as ("the
Owners"). Clients applying to book a property are referred to as
("The Tenants"). The names of all those who will be occupying the
property known as 4 Harbour View, North Quay Hill, Newquay, TR7 1GZ during the period of booking must be specified on the "Booking
Form". Any contract is between the Tenants and the Owners.
PAYMENTS
If a
booking is made six weeks or more before the tenancy is due to start it must be
accompanied by a deposit of one third of the rent. If a booking is made less
than six weeks before the start of the holiday, the full rent must be paid at
the time of booking.
Once the
booking is accepted in writing by the Owners, the Tenants are liable for
balance of the payment of rent, plus any additional charges, six weeks before
the start of the tenancy. The deposit is
non-refundable. The owners are not registered for VAT and no tax is payable by
Tenants. Payment to be made by cheque. Any charges raised against the Owners by their bank for handing any form
of payment, or charges for dishonored cheque will be passed onto the Tenants
who are liable to reimburse the Owners within 7 days of notification of same.
CANCELLATION
If cancellation
of a booking is made six weeks or more before the tenancy is due to start, the
balance will not be charged. If cancellation is made less than six weeks before
the start of the letting, the balance is payable in full. If
the balance is not paid by the sixth week before the commencement of the
letting, the Owners reserve the right to re-let the property.
ARRIVAL
& DEPARTURE TIMES
Bookings
commence at
PETS
Pets are
not allowed in the property.
LINEN
Bed Linen
is included in the price, and all beds will be made up on arrival. Towels (not
beach towels) are included.
FUEL COSTS
All gas and
electricity costs are included in the booking price.
SMOKING
Smoking is
not allowed in the premises.
PARKING
The parking
space allocated to the apartment is the one adjacent to the refuse
compound. Any vehicle and its contents
are parked entirely at the vehicle owners risk.
CONDITION
OF PROPERTY/INVENTORY
Before you
arrive your property will have been cleaned and the inventory checked.
Discrepancies should be reported within 24 hours of arrival to the Owners, the
inventory will otherwise be deemed to be correct. Losses, damage or any
cleaning necessary over and above normal servicing will be invoiced to you on
departure.
DESCRIPTIONS
The Owners
reserve the right to amend prices quoted, due to errors or omissions, or
changes in fuel rates. Changes to
external premises or facilities are outside of our control and cannot be relied
upon absolutely.
DAMAGE TO PROPERTY
The tenant is liable for the full cost of any damage caused to the
property during the tenancy.
THE TENANCY
The Tenancy
confers upon the Tenants the right to occupy for a holiday within the meaning
of schedule 1, Paragraph g of the Housing Act 1 988. The Tenants agree: (a) To
pay for any losses or damage to the property however caused (reasonable wear
and tear excepted; (b) To take good care of the property and leave it in a
clean and tidy condition at the end of the tenancy; (c) To permit the Owners
and Agents reasonable access to the property; (d) Not to part with possession
of the property or share it except with members of the party as shown on the
booking form. In no circumstances may the number of people exceed the
stipulated description;(e) Not to cause an annoyance
or become a nuisance to occupants of adjoining premises. In the event of breach
of these terms and conditions the Tenants may be required to leave the property
during the period of the booking.
LIABILITY
The Owners
do not accept liability for any act, neglect or default on the part of any
other person not within their employ, nor for any accident, damage, loss,
injury, expense or inconvenience whether to person or property, which the
tenant or anyone connected with the property may incur. The Owners reserve the
right to provide alternative accommodation or cancel the letting owing to unforeseen
circumstances beyond their control (owing to fire damage for example) or the
property is unsuitable for holiday letting, all rent and charges paid in advance
by the Tenants will be refunded in full, but the Tenants shall have no further
claim against the Owners.
All
properties are used at your own risk. Special care must be taken by Tenants at
the property as there is a balcony and stairs which are used at their own
risk. Parents should ensure that their children are supervised in such areas at
all times,
AUTHORITY
TO SIGN
The person
who signs the booking form certifies that he or she is 18 years of age or over and is authorized to agree the
Terms and Conditions on behalf of all persons included on the booking form,
including those substituted or included at a later date. He or she agrees to
take responsibility for the party occupying the property and undersrtands that single sex
groups are not allowed as occupants.
GOVERNING
LAW & JURISDICTION
The contract is deemed to have been made at Seahorses, 10, Hawthorn Park Road, Wembury, Plymouth, Devon PL9 0DB. The validity, construction and performance of this Agreement shall be governed by English Law. The Tenants submit to the exclusive jurisdiction of the English Courts.
